Introduction 1.1.

This document together with the documents referred to in this document sets forth the terms and conditions governing the use of these websites (hereinafter referred to as “terms”), and applies to contracts concluded between the user and VR Guide Me.

1.2. VRguide.me is a joint venture of Gabriela Morales, a licensed travel provider authorized to operate in the Czech Republic, and Virtual Arena ÔU, which provides virtual reality technology.

1.3. VR Guide Me recommends that the user carefully reads the Terms and Privacy Policy and Cookie Policy before using these websites, available at www.vrguideme.com. The use of the websites and their services is subject to the Terms and Privacy Policy, including the rights and obligations arising from using the websites. If the user refuses any of the terms, they must not use these websites. These Terms apply to any natural or legal person who orders services from VR Guide Me and are valid for the parties from the moment of contract conclusion. If the user refuses these terms, VR Guide Me is entitled to refuse service provision.

Service Description

2.1. VR Guide Me provides the user with a guided tour of Prague and a virtual reality experience that allows reconstructing a historical moment in the place where it occurred. The main purpose of this service is entertainment. Virtual Arena ÔU has developed technology to provide a virtual reality experience with historical accuracy, however, it is not responsible for the inaccuracies of the images or storytelling. The tour does not account for any complaints about historical inaccuracies and is not subject to such complaints.

Use or Service

3.1. The use of this service is at the user’s responsibility, and the user is ultimately responsible for their own safety and integrity.

3.2. The user is responsible for using virtual reality glasses in a safe place, following the instructions provided by VR Guide Me, specifically considering safety measures, including, among others, avoiding their use on roads or near cars, bicycles, or other vehicles, considering other pedestrians, and street conditions.

3.3. Information regarding the meeting point and location, route, schedule will be available, among others, on the website www.vrguideme.com.

3.4. Purchased tickets are valid for one year from the purchase date unless otherwise specified.

3.5. Who can and cannot use this service.

3.5. The service may be used by any person over 14 years old, as well as by any person over 12 years old in the presence of their legal guardian.

3.6. The virtual experience provides the user with three-dimensional scenes that can affect the user’s perception. Users diagnosed with epilepsy and/or seizures, conditions related to altered perception or similar conditions and mental disorders should not be users of this virtual reality experience/tour.

3.7. VR Guide Me is not responsible for any discomfort or complaints that the user may experience in this context. Virtual reality moments staged during the city tour contain visual effects that may cause agitation or unfamiliar mental states in users, so the service is not recommended for individuals with epilepsy or a tendency to it.

3.8. The service may not be used by individuals under the influence of alcohol, drugs, consciousness-lowering medication, or other intoxicating substances, as well as by persons with epilepsy or individuals who could potentially be influenced by visual and sound effects.

3.9. VR Guide Me is not responsible if the user is under any of the above conditions.

Deposit

4.1. The essential deposit is one hundred euros (100 EUR) or identity documents as a necessary step for delivering virtual reality glasses, either in cash or by credit card. If the user refuses to pay the deposit, VR Guide Me may withdraw from the contract.

Price and Payment

5.1. Service prices are available at www.vrguideme.com. Purchases through the website can only be made by credit card, while purchases in-person meetings can be made in cash or by credit card.

Data Protection and Privacy

6.1. VR Guide Me may collect user’s personal data for logistical and operational purposes and may not disclose them to third parties without prior written consent.

6.2. These privacy policies were last updated on May 17, 2022. These personal data protection policies, as well as the terms and conditions, have been developed in accordance with the EU General Data Protection Regulation (EU) 2016/679 (GDPR) and the Personal Data Protection Directive (May 2011).

Liability

7.1. Users are obliged to use the tools provided for the service with due care, especially virtual reality glasses and other accessories, and strictly follow the guide’s instructions. The user is responsible for any damage to the tools while using them, including their theft. An estimated amount of three hundred euros (300 EUR) for damaging virtual reality glasses will be deducted from the deposit, and other damages will be calculated according to their price.

7.2. VR Guide Me is not responsible for any financial or non-financial damages, including physical or psychological injury, discomfort during the tour, or death. Necessary measures have been taken to avoid user injury.

Force Majeure

8.1. The service conditions may change in the following cases:

8.1.1 Unforeseeable event (e.g., illness, accident, transport delay) accepted by VR Guide Me. If the user cannot book another suitable program date within the ticket validity period, VR Guide Me will extend the ticket validity for a maximum of 30 additional days. VR Guide Me reserves the right to assess each case individually, and it may not offer a shorter but only a longer period than the above terms.

8.1.2 Rules for Non-Appearance at the Tour: If the user fails to appear at the time of the reservation or cancels the reservation with less than 24 hours’ notice, they lose the right to change the reservation or receive a refund.

8.1.3 VR Guide Me may change or cancel the tour due to events caused directly or indirectly by forces beyond its control, including but not limited to strikes, work interruptions, accidents, war, or terrorist events, civil or military unrest, nuclear or natural disasters, acts of higher power, epidemics and pandemics, interruptions, losses or failures of public services, communication or computer (software or hardware) services, or other atmospheric conditions that prevent the service, such as heavy rain, hail, stormy wind, or similar or extreme heat. In such a case, the user is entitled to a refund or a change in the date within the next two months.

Dispute Resolution

9.1. Any disputes arising from this agreement or in connection with it will be finally settled amicably, and if not possible, through an arbitration procedure established by VR Guide Me.
